Any Booksellers doing class action law suits against eBay?

Am I the only one who finds it very difficult to take these people who capitalise words in the middle of sentences seriously? In a word, No. |

I am, however, suprised that the MOTHER of all Class-Action suits has not yet hit the fan!... the one in which there will be BILLIONS IN DAMAGES...Fees that sellers are forced to pay to ACCEPT MONEY and to enrich Pay-Pal who is owned by Ebay. Ebay might have the right to specify what form of payment THEY accept,
in no way do they have the right to tell sellers and buyers that they cannot conduct THEIR transaction in cash, money orders, checks or live chickens if they so agree. -- RARE COIN AUCTIONS NO RESERVES www.frankcoins.com http://myworld.ebay.com/frankcoins Texas Auction License 11259, Board member of Texas Coin Dealers Association, Member TNA, ANA, PCGS, NGC - Full Time Since 1991 |

Under the laws of the United States only U.S. currency is legal tender. However if eBay were to specify that only PayPal could be used that would violate anti-trust law under the Sherman Act. That is not what eBay does. Rather they are now requiring electronic payments to be available as a customer option. Now we all know that will mean that PayPal will get 95% of the transaction payment and clearing business on eBay. But as a matter of law that is just fine so long as it is not required to be PayPal only. EBay thus is not maintaining a monopoly by the use of monopoly power. EBay management may be short sighted and greedy but stupid is perfectly legal. In fact stupidity is the norm in many localities throughout America, including large parts of San Jose, California. That seems sensible. I don't use ebay much, but I have talked with quite a few dealers who are disgusted with ebay right now, due to some changes made recently, none of which seem to benefit anyone but ebay. Basically, if they keep annoying customers, someone else (and don't think there is no venture capital out there for so doing, there is plenty) is going to jump in with a better auction and payment set-up, and ebay will be passe before they know what hits them, because things happen fast on the net. It is silly (with regard to the first post on the thread) to rant about "greed" and "fascism" because it is simply another case of a management starting to slip-up and possibly run a once good company into the ground by antagonizing the people they are supposed to be serving...Right now they seem to be busy beavers -- when it comes to eroding their own customer base! The problem is that new companies trying to fill eBay's shoes have to
advertise, or have their sellers advertise. This is the biggest problems, not getting the amount of listings there to read over five million or something like that. Not a lot of people understand just how unknown most new websites are to the general public -- unless they are heavily promoted. eBay had a word of mouth thing going on very strong for its first years because it was the first online auction site that caught on. It was a brand new concept that many wanted to try. Also, these new sites have to focus on their merit, their use to the sellers, like eBay was in the early day. Too many seem to want something for themselves immediately, and are also not thinking about how to make things easy for the sellers. I've tried two so far and there were simple things they could have done to make them more successful, yet they didn't do these things. As usual these days, there is a crises of competence. The average person leading or in middle management in corporations is pretty inept, probably from having it so easy for 20 years. -- Robert Pearson ParaMind Brainstorming Software http://www.paramind.net Creative Virtue Press/Telical Books/Regenerative Music http://www.rspearson.com |
