"Code of Conduct" for Selling Coins & Paper Money on eBay

eBay has worked with the American Numismatic Association (ANA) to help
improve overall trading safety within the Coins category on eBay. Together
with the ANA, we developed a Code of Conduct for selling numismatic
material on eBay. This has been drawn from the ANA Member Code of Ethics,
ANA Dealer Code of Ethics, and specific terms of sale which are considered
"general trade practice" within the organized numismatic community. It
does not replace eBay's general seller rules and regulations, but rather
supplements those rules. Sellers are encouraged to abide by these
guidelines when selling items on eBay. Failure to do so could result in
disciplinary action by eBay and possible suspension or loss of selling
privileges. In addition, such failure may be grounds for further
disciplinary action by the ANA against its members.

Code of Conduct

. Sellers agree not to knowingly sell, exhibit, trade, produce, or
advertise a copy or reproduction of any numismatic item if its nature is
not clearly indicated by the word "copy" or "reproduction," incused in the
metal or printed on the paper thereof. These items are allowed to be sold
provided:

1) their sale does not violate applicable laws or copyrights,

2) the item is incused in the metal or printed on the paper thereof
as a copy or reproduction on the front or back, and

3) the listing title AND description clearly state that the item is a
copy or reproduction and includes an image of the marking.



Note: Restrikes are permitted for sale and they are not required to have
"copy" or "reproduction" incused in the metal or printed on the paper
thereof, if the item was produced or authorized for minting by the
original issuing government.

. Sellers agree to represent a numismatic item to be genuine only when it
is authentic to the best of their knowledge and belief. Learn more about
authentication and see a list of authentication and grading services.
Additional information is available about consumer protection at the ANA.

. Sellers agree not to knowingly handle or resell forgeries, unmarked
copies, altered coins, or other spurious numismatic merchandise that is
not clearly labeled as such.

. Sellers agree not to knowingly participate in any way in the
advertisement, sale or trade of any numismatic material using any
deceptive practices including, but not limited to, false or misleading
claims of sales scarcity, value, condition or investment potential.

. Sellers agree to sell numismatic items that they own free and clear of
any challenge or those that they are authorized by the owner to sell.

. Sellers agree not to knowingly sell or buy counterfeit numismatic
material.

. Sellers agree to promptly refund the purchase price for any item that
has been deemed by the ANA as other than as offered or described by the
seller.

. Sellers agree to abide by all laws relating to numismatic matters.

Isn't there somewhere a prohibition against this most repugnant, simpering
statement by so many sellers, "I don't know if this is real or not, so
please bid accordingly"?

Sometimes you can win out on these 'not sure' items.

A friend bought a rare Somalia postage stamp that often has
a forged overprint at a low price - he sent it to be expertised by
a leading Italian specialist and it came back as genuine!

Dear Lia,

Ebay threatens its members with suspension for discussing particular
auctions and sellers. Yet a specific item number or user name would allow
the experienced collectors to discuss and confirm obvious forgeries. One
guy in China was selling an 1805 silver dollar, which not only does not
exist with that year, but was of a design first used in 1836!

Your page to report counterfeits is well hidden..why not a link on every
seller page? After all, you have a link on every MESSAGE board to report
people who mention the user names of the sellers of illegal items! I have
reported HUNDREDS of blatant fakes. Ebay reponds with a form letter and
never once has removed anything that I reported.

Your introductory post says you have been spending a lot of time in meetings
and trainings and look forward to attending some trade shows. Do you (or
anyone who reviews counterfeit complaints) know how to spot 99% of the fake
1914-D cents in two seconds? Do you know the obvious signs of a
spark-erosion counterfeit? The "wrong look" of fake trade and bust silver
dollars? How to spot 90% of fake 1877 Indian Head cents in 2 seconds?
These can all be detected from even a less-than-perfect image on a computer
monitor. I do hope that's the type of training you are getting.

Ebay better do something fast, because allowing the same people to sell
fakes over and over, while ebay collects listing fees, final value fees and
Paypal fees, and the buyers get screwed, puts ebay in the same category as
the crooks offering this stuff.

If all of us would who care would SPEAK OUR MINDS to those eBay people
like that, by golly, maybe something will happen for the good of our
hobby, and just plain common decency. I too, have written HUNDREDS of
reports to eBay, but I have seen about 85 or so auctions pulled and two
or three sellers banned (at least for a little while) such as
"ewholesaler", "stellarcoins", westcoastpawn", see32 (now back but not
selling altered 1893-S Morgans anymore) and a couple of the "chinese
conection" sellers, who seem to appear again almost instantly.

Are we all using the same link in eBay to report these creeps, the
"REPORT" link at the bottom of the following page:

Yeah....well, the old eBay individual heard much of the same during a
live session in the eBay Coin and Currency forum several months ago
and all we got was double-talk from someone who didn't understand what
she was being told and no action.

The first positive step they could make is to put someone in charge of
that forum who has some knowledge of the hobby and it's problems.
