Default ANA/Cipoletti lawsuit against former ANA employees

I read the CW article. The former employees set up a couple of
websites to take potshots at Cipoletti. The ANA alleges a bunch of
other illegal activity along with this.

I have a feeling that this is all just a waste of time and
money and the ANA could make better use of its resourses.

It is my personal experience that Larry Lee and Brian Fanton are good
guys. IMHO, Chris Cipoletti should never have been hired in the first
place. The ANA board has a fixation on getting legal advice cheaply by
hiring a lawyer (twice now) for a job that should go to a completely
different type of person with a completely different set of skills.

I got Numismatic News yesterday and
they go into much more detail on the
case than Coin World.

It looks like this has the potential to get
very ugly if it ever gets into a court room.

Somebody posted earlier that the ANA always picks a lawyer for the
exec and it's not been a very good fit.

If there was ever a group that needed a lawyer on staff, it's the ANA.

But at least some of his time is spent dealing with ACG. That's time
well spent.

I don't know Brian Fanton, other than recognizing the name. OTOH I have
known Larry to be very forthright and honest. As you say, one of the
good guys.

A reason to read NN this week. Personally I don't like Cipoletti after
he rudely avoided me in Portland.

I don't get NN. Can someone summarize the story?



The NN story was written by Dave Ganz so it has a lawyers perspective
and
attention to detail. This is not everything. Some
of this was in the CW article as well.

Wayne Abraham (former ANA controller) emails Cipoletti multiple times
demanding a meeting with him and threatening Cipoletti with legal
action over
his termination five years earlier.

Abraham says he has "hidden" documents" at the ANA and has control of
documents in violation of his settlement agreement with the ANA

Threatens to get "legal authorities" including govt. agencies involved.

Larry Lee (ANA curator) unhappy with staffing decisions is disruptive
at the ANA
and disclosed terms by which people left the ANA. Also accused
Cipoletti of
stealing money from the ANA to finance his house. Took an ANA employee
to
lunch where he made his accusations and asked the employee to get
certain
financial records from the ANA. Employee refuses and tells Cipoletti
about the
incident.

Lee, Nebel and Nulty seen having lunch together which was interpreted
as a
conspiracy against the ANA and Cipoletti.


Two websites go up in May of 2004 with accusations against the
Cipoletti
and the ANA. The ANA says there are many false statements on them.

Accusations on the website included:\


ANA endowment funds are being grossly misappropriated

Executive director takes on virtually every title and responsiblity
for himself
and moonlights as general counsel for the ANA (a conflict of interest)
as well
as being an attorney.

Shroud of secrecy has increased to the level that is is virtually
impossible
to get a straight answer, and those employess who dare to ask are
quickly
let go.

ANA denies these allegations and first claim is for intentional
infliction of
emotional distress by outragious conduct .

Interfering with prospective business relation and economic gain

Breach of contract claim.


There is lot more legal stuff but I think those might be the main
highlights.

The other ridiculous thing noted in the NN article was Cipoletti's ANA
compensation - $218,000. He is still allowed by the ANA board to
practice law and and have side business interests while drawing such a
salary.

IMHO, Total Bull****. At a minimum, the ANA board should require his
100% undivided efforts for that ridiculous sum. Based upon his lack of
performance to date, a 90% salary reduction would be in order.
