It does not stipulate that the act of war be declared, merely defined as such.
Which the WTC act on 9-11-01 was, by President Bush.

Sorry, that's untrue. War was declared in the first Gulf War against Iraq.
That was the first declaration since WW II.

Only Congress can declare war. Although Congress let George I go to war,
they did not declare it.

There were House Joint Resolutions "authorizing use of force"
signed into law by both Bush I and Bush II, but neither was a
"declaration of war", which has numerous formal ramifications
under the Geneva Conventions.

The last declaration of war by the United States was on
December 11, 1941 (against both Germany and Italy, although
only Germany was listed in the title of the bill ...).
